The purpose of this policy is to provide you with all important information and explanations about how and why Viva Games may collect and process some of your data when you use one of our applications. This privacy policy governs and details the fundamental principles that Viva Games applies to the data we collect and process for:

Why does Viva Games collect data from its games?
When you use Viva Games games, we will collect information about you. Such information, also known as personal data, may be collected automatically by Viva Games when necessary, or voluntarily submitted by you. We use this data to provide you with the game you have downloaded, to ensure security and for other purposes described below (e.g. advertising).

When you install and use Viva Games games, we may collect and process some of your data for different purposes.

Below you will find explanations of the reasons why Viva Games may collect data and the legal basis on which Viva Games relies in each case.

Viva Games collects data:

  • To provide you with the services requested by downloading the application.
    • e.g. knowing that you have completed the first level to be able to access the second level

Legal basis: consent and service contract signed with Viva Games at the time of downloading the game: the processing of data is strictly necessary for the services requested.

  • To perform analysis and understand how users interact with our products and services in order to continually improve them, either directly or through third parties.
    • For example, identifying that a feature is annoying to users or that a level is too difficult for most players.

Legal basis for third-party analysis: Express consent of users. Data will only be disclosed to third parties with your express consent, except with those Viva Games service providers bound by a data processor contract.

  • To deliver advertising tailored to the preferences and interests of our users and to enable Viva Games to continue to provide free services and products.

Legal basis: Express Consent. In countries where the collection of user consent may be required by applicable laws and regulations, Viva Games only processes or shares personal data collected through the Viva Games games for personalized advertising purposes once you express your consent through the pop-up notice included in our games

For all data processing activities that depend on users’ consent, you can withdraw your consent at any time from the “settings” page of our various applications.

Please note that in the event that you withdraw your consent or refuse to consent in the first place, you will still be sent advertising, but it may be less relevant to you, as it will not be tailored to your interests.

What data does Viva Games collect from its games?
Viva Games may collect data that allows us to identify you directly. We only collect mobile identifiers and other technical information (if necessary, only with your consent) that allows us to recognize your device.

For all of the purposes listed above, the data collected by Viva Games is limited to the following

  • Your IP address (Singular-VIVA)
  • Your mobile advertising identifier (Apple’s IDFA or Google’s AAID, which are technical identifiers developed by mobile operating systems for advertising purposes that remain under your control and can be reset or deleted at any time through your device settings) and device identifier (e.g., IDFV for iOS devices and Android ID for Android devices). This data is only collected with your consent.
  • Information about the device you are using and its connection (user agent, connection type, timestamp, system language, device model, screen resolution and configuration, battery level, available storage space, time zone, operating system).
  • Data relating to your activities in our games and, in particular, how you interact with our games (e.g., how and when you use our games) and with advertising served in our games (e.g., number of ads served, potential clicks).

In some Viva Games games, you may choose to sign in to your account with a third party service (Google, Apple or Facebook) to enhance your experience (sync your progress across multiple devices, secure your progress and restore it in case of device loss, device upgrade, etc.). In such a case, we may collect and securely store your email address (and no other data from your account) in a hashed format within our database. Viva Games will use this information only for account recovery and customer service purposes. We will not share your email address with third parties without your consent.

With whom may your data be shared and why?
We do not sell your personal data, but they may be transferred to provide the service properly. In all cases, there is a link through the signing of the data processor contract where we guarantee that the provider complies with the provisions of the RGPD and the LOPDGDD.

When you consent to data collection for advertising and analytics purposes, we may share the data listed above with the following categories of recipients:

Advertising partners: which allow us to monetize the advertising inventory of our applications and to offer users free products and services.

How long does Viva Games keep your data?
Viva Games does not keep personal data collected, received and processed for the purposes described in this policy for longer than necessary. They will be kept as long as they are necessary to provide the requested service and thereafter for the legally established period of time.

Viva Games does not retain user-level data for more than 13 months, except for data collected for the purposes of its source analytics tool, which may be stored for up to 25 months under the guidelines of our Data Protection Supervisory Authority.

Children’s data
Viva Games never knowingly or voluntarily collects personal data from children under the age of 16. If you are under the age of 16, please do not use Viva Games games that are not intended for children under the age of 16.

International transfers
Some of the partners and processors mentioned in this policy are located outside the European Union.

In such a case, we ensure that:

  • Personal data is transferred to countries recognized as offering an equivalent level of protection.
  • For personal data transferred outside the countries to which the European Commission recognizes an adequate level of protection, any of the mechanisms offering adequate guarantees and provided for by the applicable regulations are used, in particular the adoption of the European Commission’s standard contractual clauses.

Withdrawal of consent and opting out of the sale of information
You can change your consent status at any time from the Privacy Settings available in Viva Games mobile games.

Please note that Viva Games may share your data with third parties, such as analytics and advertising companies, in order to improve and personalize your experience and tailor content and advertisements on our services.

Adjusting your consent settings in Viva Games will allow you to block data collection for these purposes and will de facto prevent information from being shared with our analytics and/or advertising partners.

Right of access
Upon request, Viva Games will provide you with information about whether we retain any of your personal information. You may access or request deletion of your personal information directly in the Viva Games mobile applications or by contacting the Viva Games Data Protection Officer as indicated in the “Contact Us” section below. We will respond to your request within a reasonable period of time.

Rectification and deletion
You may request Viva Games to delete your personal data without undue delay when it is no longer necessary for Viva Games to retain such data.

To delete your data or make it inaccessible, you can:

  • reset your mobile advertising identifier (IDFA on iOS, GAAID on Android) or enable the “Limit Ad Tracking” option in your device settings so that previously collected data can no longer be linked to you or your device and limit further data collection if you choose to enable the “Limit Ad Tracking” option.
  • contact Viva Games’ data protection officer, as indicated in the “Contact” section below, in order to have the data previously collected by Viva Games about you and/or your device permanently deleted or anonymized

Intellectual property of hosted content

It is forbidden the use contrary to the legislation on intellectual property of the services provided by VIVA GAMES S.L. and, in particular, of:

  • The user is responsible with respect to the laws and regulations in force and the rules that have to do with the operation of the online service, e-commerce, copyright, maintenance of public order, as well as universal principles of Internet use.
  • The user shall indemnify VIVA GAMES S.L. for the expenses that will generate the imputation of VIVA GAMES S.L. in any cause whose responsibility was attributable to the user, including fees and expenses of legal defense, even in the case of a non-final judicial decision.

Protection of hosted information

VIVA GAMES S.L. makes backup copies of the contents hosted in its servers, however, it is not responsible for the loss or accidental deletion of the data by the users. In the same way, it does not guarantee the total replacement of the data deleted by the users, since the mentioned data could have been deleted and/or modified during the period of time elapsed since the last backup.

Commercial communications

In application of the LSSI, VIVA GAMES S.L. shall not send advertising or promotional communications by e-mail or any other equivalent electronic communication means which have not been previously requested or expressly authorized by the addressees of the same.

In any case, the user, after proving his/her identity, may request that no further commercial information be sent to him/her through the Customer Service channels.
